1. Agreement to Terms
Welcome to Fifty Most Beautiful (the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and VKM Sidecar LLC, doing business as Fifty Most Beautiful ("Company," "we," "us," or "our").
2. Eligibility
2.1 Viewing Public Content
Anyone may view publicly available content on the Service, including candidate profiles and those selected as Fifty Most Beautiful. No account is required to browse this content.
2.2 Participating (Nominating and Voting)
To create an account and participate in nominations or voting, you must:
- Be at least 18 years of age
- Be a current student at University of Miami
- Have a valid .edu email address from University of Miami
- Have the legal capacity to enter into binding contracts
By creating an account, you represent and warrant that you meet these eligibility requirements.
3. Account Registration and Security
To access certain features, you must create an account using your .edu email address. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
- Use only one account per person
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Nominations
4.1 Nomination Rules
When submitting a nomination, you agree to:
- Good Faith: Submit nominations in good faith for real students at your university
- No Self-Nominations: Not nominate yourself (self-nominations are strictly prohibited)
- Public Content Only: Only share publicly available TikTok video links
- Respectful Intent: Not nominate anyone with malicious, harassing, or discriminatory intent
- Accurate Information: Provide the nominee's correct name and valid TikTok link
- Acknowledgment of Opt-Out Rights: Understand that nominees may request removal at any time
4.2 Nomination Review
All nominations are subject to review and approval before being published. We reserve the right to reject any nomination for any reason, including but not limited to:
- Suspected self-nominations
- Duplicate nominations
- Invalid or broken links
- Inappropriate or harassing content
- Violations of these Terms
5. Voting
When participating in voting, you agree to:
- Cast votes honestly based on your genuine preferences
- Not use automated tools, bots, or scripts to manipulate voting
- Not create multiple accounts to vote multiple times
We reserve the right to remove votes or ban users suspected of vote manipulation.
6. Use of Third-Party Content
6.1 TikTok Content
The Service displays publicly available content from TikTok, including video thumbnails and profile information. By nominating someone or being featured:
- You acknowledge that this content is already publicly accessible on TikTok
- We use TikTok's official embedding and thumbnail APIs in compliance with TikTok's Terms of Service
- TikTok content remains subject to TikTok's own terms, policies, and copyright
- We do not claim ownership of any TikTok content displayed on the Service
6.2 Attribution
All TikTok content includes clear attribution to the original creator and links directly to their TikTok profile.
7. Opt-Out and Removal Rights
If you are featured as a nominee and wish to be removed from the Service:
- You may request removal at any time via our Opt-Out page
- We will verify your identity (via .edu email) before processing your request
- We will remove your profile from public view within a reasonable timeframe
- Your candidacy may be restored by administrator action, but any votes you received prior to opt-out cannot be restored
We respect your right to control your online presence and will honor all legitimate opt-out requests.
8. Prohibited Conduct
You agree NOT to:
- Use the Service for any unlawful purpose
- Harass, bully, defame, or intimidate others
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to the Service or other users' accounts
- Use automated tools (bots, scrapers, etc.) without permission
- Interfere with the proper functioning of the Service
- Reverse engineer, decompile, or hack the Service
- Violate any applicable laws or regulations
- Infringe on others' intellectual property rights
- Collect or store personal data about other users without consent
9. Intellectual Property
9.1 Service Ownership
The Service, including its design, code, text, graphics, logos, and functionality, is owned by the Company and is protected by copyright, trademark, and other intellectual property laws.
9.2 User Content License
By submitting nominations or other content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and store that content for the purpose of operating the Service.
9.3 Third-Party Content
TikTok content displayed on the Service remains the property of the respective TikTok creators and TikTok, Inc.
10. Disclaimers and Limitations of Liability
10.1 "As-Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.2 No Guarantee of Accuracy
We do not guarantee the accuracy, completeness, or reliability of any content on the Service, including voting results or user-submitted information.
10.3 Third-Party Services
We are not responsible for the availability, accuracy, or content of third-party services (including TikTok), or for any damages resulting from your use of such services.
10.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.
In no event shall our total liability exceed $100 USD or the amount you paid us in the past 12 months, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your nominations, votes, or other content submitted to the Service
12. University Affiliation
This Service is NOT officially affiliated with, endorsed by, or sponsored by the University of Miami. The Service is an independent platform created for student entertainment and engagement.
University names, logos, and trademarks are used solely for identification purposes and remain the property of their respective institutions.
13. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
14. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.
16. Changes to These Terms
